This presentation explains what HIPAA does—and does not—do for fiduciaries and health care decision-makers. It focuses on practical access issues that arise when a fiduciary, surrogate, proxy, or guardian seeks medical information or records.

Areas to be covered include:

  • Does a legal document or statute authorize the fiduciary and does HIPAA require the provider to recognize that authority?
  • What access does a fiduciary have to protected health information pursuant to HIPPA?
  • How does a fiduciary resolve a denial to protected health information?

Alexandra V. Rieman was admitted to the Florida Bar in October 1986. In private practice from 1986 to 2003 she represented clients in family law, medical malpractice, criminal law, juvenile dependency and delinquency, probate, guardianship, employment discrimination, and corporate law.

In November 2003 she joined the Seventeenth Judicial Circuit. While at the Circuit Alexandra was Probate Counsel and General Counsel.

Upon leaving the Seventeenth Judicial Circuit, Alexandra formed GAPS Legal, PLLC with Michelle Kenney in January 2018.
