Undue Influence…How to recognize it and what are a fiduciary's responsibilities!

Shannon M. Miller is a Florida Bar board certified attorney specializing in Elder Law, practicing in Gainesville, Florida. In 2012, Shannon served as a drafting member of the Financial Exploitation of Vulnerable Adults Workgroup, led by Florida State Senator Kathleen Passidomo. That statute (§ 825.103) became law in 2014, creating groundbreaking tools for law enforcement, prosecutors and civil practitioners to crack down on the exploitation of our most vulnerable citizens. In 2018, Shannon, as part of the Elder Law Section, created new legislation relating to injunctions against exploitation and freezing stolen assets (Fla. Stat. § 825.1035). Shannon has been instrumental in rolling out the Exploitation Injunction law across the state of Florida and assisted in the drafting of the new Attorney General/Elder Law Section HB 1041 for new and powerful Anti-Exploitation laws effective July 1, 2021.
Shannon served as President of The Academy of Florida Elder Law Attorneys, currently serves on the Florida Joint Public Policy Task Force for the Elderly and Disabled, served as Chairperson of the Legislative Committee of the Elder Law Section and now serves as Vice Chair of the Elder Law Section of the Florida Bar.
